Instagram Giveaways - Terms & Conditions

The contest is run by Orbasics GmbH, Warschauer Str. 59A, 10243 Berlin, (hereinafter referred to as "Orbasics"). The contest is not connected to Facebook or Instagram, it is neither sponsored, supported nor organized by Instagram.

1) Participation

1.1. All natural persons who have correctly provided the mandatory data and have accepted these conditions of participation are eligible to participate. Employees of Orbasics as well as their relatives and all persons involved in the conception and implementation of the contest are excluded from participation. 

1.2. Participation in the contest takes place as described in the respective post, such as by following, liking, commenting, or newsletter registration. The prize, the start and end date of the contest, as well as the age and residency requirements are mentioned in the respective post. 

1.3. By participating in the respective contest, these conditions of participation are automatically accepted.

1.4. Participation is free of charge, voluntary and not linked to a purchase obligation. Orbasics reserves the right to change or correct the conditions of participation at any time within the scope of what is legally permissible.

1.5. Multiple participation is possible under the conditions stated in the respective post. Orbasics reserves the right to cancel or terminate the contest at any time without prior notice and without giving reasons.

2) Prize and notification of prize

2.1. The winner will be determined at random from all eligible participants after the end of the contest. 

2.2. The winner will be notified of the win via the Direct Message feature on Instagram or via email. The winner must contact Orbasics within 5 working days (from the date of notification of the prize) and provide their contact and address details. Orbasics can be contacted by the winner via "Direct Message" to the Orbasics Instagram page or via email to hi@orbasics.com. If the winner does not confirm acceptance of the prize during this time, the claim to the prize will be forfeited without compensation. In this case, Orbasics is entitled to conduct a substitute draw. There is no obligation to accept the prize. 

2.3. The prize is neither transferable, nor can the prize be exchanged or paid out in cash.

2.4. If circumstances arise for which Orbasics is not responsible, the winner agrees to accept an appropriate substitute prize.

2.5. A cash payment of the prize or discount value and an exchange of the prize are excluded. The prize is not transferable.

2.6. In the event of a win, the winner agrees to the publication of his/her name or Instagram handle on the media used by Orbasics. This includes the announcement of the winner on the website of Orbasics and its social media platforms.

2.7 Any costs incurred for shipping the prizes outside Germany shall be borne by the recipient. Any additional costs associated with claiming the prize shall be borne by the winner. The winner is responsible for any taxation of the prize.

3) Severability clause

Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms & Conditions. Instead of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Terms & Conditions.

1) Processing of your personal data in the context of the giveaways.

We process your personal data for the proper execution and processing of the contest and in particular for sending the prize.

In order to carry out the contest, the profile name and, if available, the first and last name of the respective participant are collected and stored.

In order to send the prize, we also collect the surname and first name as well as the address from the winner(s) and pass this data on to a shipping company commissioned by us. Your data will not be passed on to third parties beyond this.

The legal basis for this processing of your personal data is Art. 6 para. 1 lit. b GDPR (implementation of pre-contractual measures and fulfillment of a contract).

If participation in the contest is made dependent on consent to receive our newsletter, we also collect your email address for the purpose of sending the newsletter. We use the so-called double opt-in procedure for sending the newsletter. This means that we will only send you email newsletters once you have expressly confirmed to us that you consent to the collection and storage of your data for the purpose of sending newsletters in accordance with Art. 6 Para.1 lit. a GDPR. We will then send you a confirmation e-mail asking you to confirm that you wish to receive future newsletters by clicking on a corresponding link. By activating the confirmation link, you give us your consent for the use of your personal data in accordance with Art. 6 (1) lit. a GDPR. The data collected by us when you register for the newsletter will be used exclusively for the purpose of addressing you in an advertising manner by way of the newsletter. It will not be passed on to third parties. You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter or by sending a corresponding message to the responsible person named at the beginning. After unsubscribing, the newsletter will be discontinued and your e-mail address and any other data provided in this context will be deleted from our newsletter distribution list immediately, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you below.

2) Storage period

After the end of the contest, your personal data processed as part of the contest will be deleted no later than three months after the end of the contest, unless there is effective consent for further processing (for example, with regard to newsletter dispatch) and/or there is no continued legitimate interest on our part in further storage.

3) Your data subject rights

The applicable data protection law grants you the data subject rights listed below if the respective legal requirements are met:
